Boats & Motorcycles

Whether you are on land or on the water, California driving under the influence laws apply.  In San Mateo, it is illegal for any person to operate a car, truck, motorcycle, and/or boat while under the influence of drugs, alcohol, or both.

Motorcycles and San Mateo DUI Law
It is illegal to operate a motorcycle while under the influence of drugs, alcohol, or both according to San Mateo DUI law.  It is also illegal to operate a motorcycle with a blood alcohol concentration of 0.08% or higher.  If law enforcement notices a motorcyclist engaging in erratic driving behaviors, they will make a traffic stop.  DUI traffic stops for motorcyclists are very similar to DUI traffic stops for car and truck drivers. 

Once a motorcyclist has been stopped for driving under the influence, he/she will be asked to submit to a blood alcohol test and field sobriety tests.  These tests are voluntary, which means the motorcyclist may refuse to submit to them.  After the tests are administered, or after the person refuses, law enforcement will decide if the person should be placed under arrest.  If the motorcyclist is placed under arrest, he/she will be read his/her Miranda Rights and his/her driver's license will be confiscated.  The person will then be escorted to the police station where he/she may contact an attorney.

Boating and San Mateo DUI Law
In San Mateo, it is illegal for a person to operate a boat with a BAC (blood alcohol concentration) of 0.08% or higher.  If a person operates a boat with a BAC of 0.08% or higher, he/she will be placed under arrest or fined for violating California DUI law.

DUI Penalties
After a person is found guilty of motorcycling or boating under the influence, he/she may be punished with time in jail, fines, probation, DUI School, and driver's license suspension.
